Dealing with the death or incapacity of a loved one is very difficult. At Patterson & Associates, P. A., we aim to ease your burden by guiding you through the probate process. Our attorneys are here to assist you in the following probate and trust matters:

Probate Administration – Our firm assists the Personal Representative in interpreting the terms of a Will, counsels the Personal Representative in dealing with beneficiaries and creditors, guides the Personal Representative through the Estate administration process, and actively works with the Probate Court in handling these matters.

Guardianship/Conservatorship Appointments – If a Guardian or Conservator is needed for a minor or incapacitated adult, our firm can assist you in obtaining this appointment. Our firm also has experience in defending against the appointment of these fiduciaries.

Probate Litigation – We represent Personal Representatives and Estate beneficiaries in prosecuting or defending any claims in the Probate Court including, but not limited to, the following:

• Will Contests;
• Elective Share claims;
• Breach of Fiduciary Duty claims;
• Removal of a Personal Representative; and
• Disputes between Co-Personal Representatives.

Trust Administration – We assist Trustees in the interpretation of Trust documents and counsel Trustees in the administration and distribution of the Trust Estate.

Trust Litigation – We represent Settlors, Trustees and Trust beneficiaries in the following types of trust litigation:

• Modification or termination of a Trust;
• Disputes between the Trustees and beneficiaries relating to distributions; and
• Co-Trustee disputes.
